Act 1/2002 provides the framework to develop the executive powers of the State and the Autonomous Communities exclusively in relation to prohibited behaviour (agreements, abuses and unfair competition). [1]

The necessary coordination and collaboration mechanisms are established between the different administrations with a view to pooling the activities carried out by each one, avoiding the duplication of efforts and divergent actions in the sole and common objective of achieving greater efficiency in the defence of free competition.

The State holds legislative power and is responsible for all executive actions in relation to practices that may alter free competition at the supra-autonomous level or in the national market as a whole.  This includes competition relating to behaviour that could threaten the unity of the national market or principles recognised in the Constitution such as the establishment of an adequate and fair economic balance between the different parts of Spanish territory, the freedom of movement and establishment of persons and the free movement of goods throughout the national territory, and the equality of all Spanish citizens in the exercise of their rights and in the fulfilment of their constitutional duties.

The objective competence attributable to the Autonomous Communities is limited to executive actions that have to be carried out in the region of each community and that do not affect the super-autonomous market.

The authorities responsible for processing the files are exclusive, therefore, when there is disagreement between authorities about who is competent to hear the case, either of the authorities in conflict can request the convening of the Advisory Board on conflicts, which is obliged to issue the corresponding, non-binding report within fifteen days, and the corresponding conflict of competence can be raised before the Constitutional Court.

We consider it essential to strengthen and energize collaboration with the various authorities that hold competencies in the audiovisual field at the regional level.

The collaboration with the different authorities that have competencies in the audiovisual field at the autonomous community level must be strengthened and revitalised.

The main objective of this institutional collaboration is to maintain a constant line of participation in all matters of common interest to these institutions. 

A consistent and coordinated application of the General Audiovisual Communication Act 13/2022 of 7 July is essential to guarantee adequate fulfilment of the public objectives of the law (protection of minors, control of advertising, promotion of European works, linguistic diversity, etc.), as well as a level playing field among providers.
For these purposes, it is important to remember that the General Audiovisual Communication Act 13/2022, of 7 July, is a basic regulation, applicable to all the Autonomous Communities, without prejudice to the reserved competences in this matter.
