Administrative claims: article 26 of the Law on Ensuring Market Unity

We are involved as a point of contact in administrative claims submitted by the operators.

Claims can be submitted against rulings, actions, or regulatory provisions of the competent authorities when these are contrary to freedoms of establishment or circulation. The Secretary of the Board for the Market Unit (Ministry of the Economy and Competitiveness) is responsible for managing the procedure. This procedure is finalised via an express resolution or by dismissal through tacit acceptance, which is understood to occur if the competent authority affected does not provide resolution within a period of 15 days.

Our involvement as a point of contact involves the possibility of issuing a report during this procedure. The claim described in article 26 of the Law is closely linked with the possibility of challenging rulings and regulatory provisions that are contrary to market unity by means of a special appeal established by the same Law.
