Complaints or reports about audiovisual content

If you detect any breach of Law 13/2022, of July 7, General Audiovisual Communication Law in any program or commercial communication of national scope, you can file a complaint or report to the Audiovisual Subdirectorate.

For regional services, such as local and regional television, FM radio, and certain services aimed primarily at users established in an Autonomous Community, complaints or reports should be directed to the competent authority of that Autonomous Community.

Some of the reasons for filing a complaint or report with the CNMC may include the following:

About programs or advertising on television, radio, or video on demand

Regarding programs, broadcasting content that clearly promotes hatred, contempt, or discrimination or whose age rating is inappropriate, dissemination of the name, image, or other data that allows the identification of minors in the context of criminal acts, broadcasting gambling and betting or content related to esotericism and pseudoscience outside the permitted time slot, etc.

Regarding advertising, for example, broadcasting forms of advertising other than announcements without overlaying the indication "advertising," using sponsorship or product placement to directly encourage the purchase of goods or services, broadcasting product placement during children's programming, commercial communications that violate human dignity or use the image of women in a degrading or discriminatory manner, covert advertising or advertising of cigarettes and other tobacco products or the companies that produce them, advertising of alcoholic beverages aimed at minors, etc.

About content or advertising on video-sharing platforms

Regarding content, platforms that lack mechanisms allowing users to notify or indicate to the corresponding provider illegal content, that lack systems allowing users to rate content (whether directly accessible or not) that may harm the physical, mental, or moral development of minors, or user-controlled parental control systems regarding content, age verification tools to protect minors and prevent access to scenes containing gratuitous violence or pornography, or transparent, effective, and user-friendly procedures for handling and resolving user complaints, etc.

Regarding advertising, if it lacks functionality for users uploading videos to declare whether they contain audiovisual commercial communications or if it does not inform users when programs and user-generated videos contain audiovisual commercial communications, etc.

About users of special relevance (UER)

For broadcasting content that clearly promotes hatred, contempt, or discrimination based on birth, race, sex, religion, nationality, opinion, or any other personal or social circumstance, or that is potentially harmful to minors without containing sufficient information describing its nature, etc.

Regarding advertising, it is possible to report the broadcasting of unidentified advertising, sponsorship, or product placement that directly encourages the purchase of goods or services or refers to specific promotions of these, or product placement in children's content, commercial communications that violate human dignity or use the image of women in a degrading or discriminatory manner, covert advertising or advertising of tobacco products or the companies that produce them, as well as alcoholic beverages aimed at minors, etc.

About the advertising field. Directed to Autocontrol

The main media outlets, agencies, and advertisers in the country are part of "Autocontrol." Autocontrol provides consumers with a free extrajudicial claims processing system that allows for the quick and effective resolution of claims against already disseminated advertising campaigns, in cases where the consumer believes they violate legal or ethical standards. Submit the claims you consider from there.
